Boulder County, Colorado Arrest Records

A Boulder County arrest record documents a police apprehension, regardless of the final legal outcome. They are considered public under the Colorado Open Records Act (CORA). The Sheriff’s Office is the keeper of arrest records in Boulder County and provides access to them online and in person during business hours. In Boulder County, the release of criminal offender record information is also controlled under the CORA.

Are Arrest Records Public Information in Boulder, Colorado?

Yes. The Colorado Open Records Act (CORA) requires that all arrest records be open for public inspection. Therefore, law enforcement agencies in Boulder County release arrest records in their custody to the public upon request. Requesters are not required to submit any form of identification to request or inspect arrest records. However, the CORA permits law enforcement agencies to take reasonable measures to ensure that records that need to be protected from the public remain confidential. Examples of confidential arrest records in Boulder County include:

  • Investigatory records
  • Juvenile arrest records
  • Medical or mental health records
  • An arresting officer’s personal email address, phone number, and home address
  • A confidential informant, witness, or victim’s identifying or contact details
  • Any arrest documents containing confidential intelligence and confidential security procedures
  • Any arrest documents containing identifying information of a child victim or witness (C.R.S. 24-72-304).

Boulder County Arrest Search

A Boulder County arrest search can be performed online or in person at the Colorado Department of Corrections (CDOC). The CDOC has an Offender Search tool that allows members of the public to find arrest records without charges. Users must provide a first name, DOC number, last name, or gender to find the appropriate records. In-person requests can be made at any of the CDOC’s 21 facilities during business hours. Records staff charges a small fee for copies of arrest records.

Individuals can also view or obtain copies of Boulder County arrest records from federal law enforcement agencies. For example, the Federal Bureau of Prisons (BOP) provides an Inmate Locator for inmate searches in its facilities. Users can freely find arrest information when searching by number or name. Requesters can also visit any BOP facility to submit in-person requests. Similarly, the U.S. Immigration and Customs Enforcement (ICE) provides free online access to Boulder County arrest records through its Online Detainee Locator System. The search criteria are the detainee’s A-Number or name. The ICE has local field offices and detention facilities that requesters may visit to obtain copies of Boulder County arrest records.

The Federal Bureau of Investigation (FBI) is one of the federal agencies that restricts access to arrest records of Boulder County offenders in its custody. The FBI only issues its records to subjects of records online, by mail, and through approved channels. Copies of records cost $18 and are payable by money order, credit card, or certified check.

Boulder County Inmate Locator

The Boulder County inmate locator (called the Daily Booking and Listing Reports) is available on the jail’s official website. The locator has several tabs that provide information about inmate listings, bookings, releases, jail population, and historical statistics. Users can filter the records on the inmate listing tab by name.

Active Warrant Search in Boulder County

An arrest warrant is a written order issued by a Boulder County judge and directed to any peace officer, commanding them to arrest the person named or described in the order (Colo. Rev. Stat. § 16-1-104 (18)). An arrest warrant is only issued based on an affidavit sworn to or affirmed before a notary public or judge that contains sufficient information to establish probable cause that someone has committed a crime. After an arrest is made, the peace officer must bring the defendant before the nearest judge of a court of record without unnecessary delay (Colo. Rev. Stat. §16-3-108). Boulder County peace officers are required by law to execute a warrant under the Colorado Rules of Criminal Procedure.

How to Find Arrest Records for Free in Boulder County

The Boulder County Jail Listing & Daily Booking Reports portal is the only free option for finding arrest records in Boulder County. The portal has several tabs that allow users to access information on inmate listings, bookings, releases, jail population, and historical statistics. This free tool excludes older arrest records and confidential arrest information. Users cannot download copies of arrest records on the portal. For older arrest records, requesters may call the Boulder County Sheriff’s Office at (303) 441-3600 to make inquiries. Those who want copies of arrest records should submit a request at the Records Request Center.

Boulder County Arrest Report

A Boulder County arrest record is an administrative entry in the jail management system that contains vital information about the arrest and the arrested person. The information is usually gathered during the booking process. Arrest records are just snapshots that show that someone was taken into custody, but they do not explain the reason for the arrest. Members of the public can easily access arrest records online through the Boulder County Jail Listing & Daily Booking Reports portal.

Conversely, a Boulder County arrest report is the police officer’s written narrative describing the circumstances that led to the arrest. The report provides a detailed account of the arrest, including the probable cause, sequence of events, any evidence found at the arrest location, the officer’s observations, and any relevant witness or suspect statements. An arrest report is usually part of the investigative case file and is deemed confidential.

How to Get an Arrest Record Expunged in Boulder County

Expungement is the process of hiding a person’s arrest records from public view. The expunged records will only be accessible to the courts, prosecuting and defense attorneys, and law enforcement. The level of the offense determines the process a petitioner may follow to have their records expunged. Generally, the process begins with the petitioner filing the appropriate forms and the required filing fees with the Boulder County Combined Court.

To seal criminal conviction records under C.R.S. 24-72-706, eligible petitioners should submit an online request to the Colorado Bureau of Investigation (CBI) for their criminal history records. Within 20 days of receiving the report, file the report alongside a completed Motion to Seal Criminal Conviction Records (JDF 612) form with the court. The filing fee is $65. The judge can either enter or sign an Order to Seal Conviction Records or Order Denying Request to Seal Conviction Records, depending on the outcome of the application. The court will send a copy of the order to the petitioner by mail.

Per C.R.S. 24-72-704, the CBI automatically seals the records of those whose arrests occurred on or after January 1, 2022, and for whom no criminal charges have been filed within one year. However, if the arrest occurred after January 1, 2019, but before January 1, 2022, there is a waiting period before they are automatically sealed. If the arrest record does not qualify for automatic sealing, eligible petitioners may file a Petition to Seal Arrest & Criminal Records with the court and pay a filing fee. Anyone unable to pay the filing fee may complete a Motion to File Without Payment and Supporting Financial Affidavit (JDF 205) and file it with the court. Once the petition is granted, the judge will sign the Order to Seal Arrest and Criminal Records When No Charges Filed Form.

If the petitioner wants to seal multiple conviction records (C.R.S. 24-72-709), they may file a Petition to Seal Multiple Conviction Records with the court and pay the applicable fee. Upon approval of the petition, the judge will sign the Order to Seal Multiple Conviction Records form.

How Do You Remove Boulder County Arrest Records From the Internet?

The easiest way to remove arrest records from law enforcement agencies’ official websites is to request that the records be sealed. The applicant should file the appropriate sealing form with the Boulder County Combined Court. Upon approval of the sealing, the court clerk will send the sealing order to all relevant agencies that are obligated to remove the applicant’s arrest records from public view. The applicant will not find their records in law enforcement agencies’ online databases after they are updated.

Arrest records may still appear on third-party databases even after expungement. In such cases, interested persons may submit an opt-out request to the third-party vendor, accompanied by a court order confirming that the arrest has been sealed.

What Do Public Boulder County Arrest Records Contain?

Public arrest records in Boulder County contain the following information:

  • The arrested person’s last, middle, and first name
  • The booking number, date, and time
  • The arrested person’s race, gender, hair and eye colors, age, weight, and height
  • Charges, arresting agency’s name, arrest date, and bond amount
  • Court date and time, scheduled end date, and release date
